Welcome to Delulu Tees. These Terms of Service describe the rules and conditions that apply when you visit our website, purchase products, submit custom merch designs, upload artwork, use our custom apparel designer, or otherwise interact with Delulu Tees.

These Terms of Service are a legally binding agreement between you and Delulu Tees LLC (“Delulu Tees,” “we,” “us,” or “our”).

By accessing or using our website, placing an order, submitting a custom merch request, or uploading any artwork, image, logo, design, or other content, you agree to these Terms of Service. If you do not agree, you should not use our website or purchase from Delulu Tees.

Custom Apparel

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order, submit a custom merch request, or use the Human Intelligence (H.I.) Image Generator through Delulu Tees.

By using our website, placing an order, submitting a custom merch request, or submitting an H.I. Image Generator request, you confirm that you have the legal authority to enter into this agreement.

If you are placing an order or submitting a request on behalf of a business, school, organization, team, group, or other entity, you confirm that you have authority to act on behalf of that entity.

2. No Customer Accounts

Delulu Tees does not currently offer customer accounts.

Customers check out as guests or through available checkout/payment options. Customers are responsible for reviewing and submitting accurate contact, billing, shipping, product, size, quantity, and order information before completing a purchase, even when information is auto-filled, imported from a payment method, or provided through an express checkout option such as Apple Pay.

3. Products and Services

Delulu Tees sells original apparel products, including:

  • T-shirts
  • Long sleeves
  • Sweaters
  • Hoodies

We may also offer additional products in the future, including totes, accessories, or other merchandise.

Delulu Tees also offers custom merch services. Customers may upload artwork, logos, photos, or other design files through our custom apparel designer or contact us by email for custom merch inquiries.

Delulu Tees also offers the Human Intelligence (H.I.) Image Generator, a human-created image service offered for entertainment purposes. Through this service, users may submit an email address, written image prompt, and optional reference images. Delulu Tees may then create and email a finished image based on the submission.

4. Order Information

When placing an order, you agree to provide accurate, complete, and current information, including your name, email address, billing information, shipping address, product selections, sizes, quantities, and any custom design instructions.

Delulu Tees is not responsible for delays, failed deliveries, incorrect shipments, or other issues caused by inaccurate or incomplete information provided by the customer.

5. Payments

Payments are processed through WooPayments or related payment processing services.

By placing an order, you authorize the payment processor to charge the payment method provided for the total order amount, including product price, applicable shipping charges, taxes where required by law, and any other charges shown at checkout.

Delulu Tees does not intentionally store full credit card numbers or complete payment card details on our own systems.

6. Taxes

Sales tax will be charged where required by law.

Delulu Tees currently operates from California and sells across the United States. Tax collection requirements may vary based on customer location, applicable law, and Delulu Tees’ tax obligations at the time of purchase.

7. Shipping

Delulu Tees ships orders using USPS.

Shipping dates, delivery dates, and timelines are estimates only. Delulu Tees is not responsible for USPS delays, carrier delays, weather delays, incorrect delivery scans, missed delivery attempts, or other shipping issues outside our control once an order has been handed to the carrier.

Customers are responsible for providing a complete and accurate shipping address.

8. Production Timeline

For orders under 1,000 pieces, the typical production and delivery timeline is approximately 5 to 10 business days, including standard shipping.

This timeline is an estimate only and is not guaranteed. Larger orders, custom orders, bulk orders, delayed approvals, artwork issues, inventory shortages, carrier delays, or unusual order requirements may extend the timeline.

9. Custom Merch Orders

Customers may submit custom merch designs through our custom apparel designer or by emailing us.

By submitting a custom merch order, upload, design, image, logo, photo, text, or other content, you confirm that:

  • You own the content, or
  • You have permission, license, or legal authority to use the content, and
  • The content does not violate any copyright, trademark, privacy right, publicity right, or other legal right of another person, business, school, team, organization, or brand.

You are solely responsible for any artwork, logos, photos, text, or other materials you upload or provide to Delulu Tees.

Delulu Tees may reject, cancel, or refuse any custom merch order or uploaded content that we believe, in our sole discretion, is:

  • Illegal
  • Offensive
  • Hateful
  • Harassing
  • Threatening
  • Sexually explicit
  • Infringing
  • Misleading
  • Unsafe
  • Not suitable for printing
  • Too low quality for production
  • Otherwise inappropriate or inconsistent with our business standards

Delulu Tees may also request revised artwork, higher-resolution files, clarification, or approval before producing a custom merch order.

9A. Human Intelligence (H.I.) Image Generator

The Human Intelligence (H.I.) Image Generator is a human-created image service offered for entertainment and personal, non-commercial use only.

Users may submit:

  • An email address
  • A written image prompt
  • Optional reference images or other uploaded materials

H.I. images are created by a human using Photoshop and may include stock photography, commercially licensed assets, edited images, composited elements, collage-style artwork, and other materials used with permission or under applicable licenses. Delulu Tees does not claim ownership of third-party stock photographs, licensed assets, or other third-party materials incorporated into an H.I. image.

H.I. images are intended as humorous, novelty, or entertainment images and are not provided for resale, commercial distribution, merchandise production, advertising, branding, licensing, or other commercial use.

By submitting an H.I. request, prompt, reference image, photo, or other material, you confirm that:

  • You own the submitted material, or you have permission or legal authority to provide it to Delulu Tees;
  • Your submission does not violate any copyright, trademark, privacy right, publicity right, or other legal right of another person or entity;
  • You are not requesting content that is illegal, infringing, sexually explicit, hateful, harassing, threatening, abusive, deceptive, or otherwise inappropriate; and
  • You understand that Delulu Tees may decline any request in its sole discretion.

Any estimated completion timeline, including an expected turnaround time of approximately 1 to 2 business days, is an estimate only and is not guaranteed.

Delulu Tees collects the email address submitted through the H.I. Image Generator only for purposes of reviewing the request, creating the requested image, communicating about the request if needed, and delivering the finished image by email. Delulu Tees does not sell submitted email addresses or use them for unrelated marketing purposes based solely on an H.I. submission.

The submitted email address, written image prompt, and uploaded reference images associated with an H.I. request will be deleted within 5 calendar days after submission, subject to technical limitations, legal obligations, fraud prevention, dispute resolution, or other circumstances where retention may be reasonably necessary.

Users may not sell, license, redistribute, reproduce for commercial purposes, or otherwise commercially exploit an H.I. image or any stock photograph, licensed asset, or third-party material incorporated into it.

10. Custom Merch Artwork and File Quality

Customers are responsible for submitting artwork that is suitable for printing.

Low-resolution files, blurry images, poor-quality artwork, incorrect sizing, transparent background issues, color limitations, placement issues, or other design problems may affect the final printed product.

Delulu Tees may provide guidance, but we are not responsible for final print issues caused by customer-submitted artwork, incorrect files, low-quality images, misspellings, layout mistakes, unauthorized designs, or customer-approved proofs.

11. Mockups, Previews, Placement, and Color Accuracy

Product mockups, design previews, and custom apparel previews are estimates only.

Final print size, placement, color, scale, texture, and appearance may vary slightly based on factors including:

  • Apparel size
  • Apparel style
  • Garment material
  • Fabric dye method
  • Print method
  • Artwork quality
  • Product color
  • Lighting
  • Screen or monitor settings
  • Manual production tolerances

Colors shown on a screen may not exactly match the final printed product. By placing an order, you understand and accept that slight variations may occur.

12. Order Changes and Cancellations

Standard Delulu Tees Products

Orders for standard Delulu Tees products may be canceled before shipment.

Once an order has shipped, it can no longer be canceled.

Custom Merch Orders

Custom merch orders may be canceled within 24 hours of placing the order, unless production has already started.

After 24 hours, or once production has started, custom merch orders may not be eligible for cancellation, refund, or modification.

Depending on the size, status, and materials involved in the custom order, cancellation or return requests may be subject to a restocking fee.

13. Bulk Orders

Bulk orders, large custom orders, group orders, school orders, team orders, business orders, and other high-volume orders may require additional approval, payment, deposit, production planning, or written confirmation.

Bulk orders may have different pricing, timelines, cancellation terms, return terms, and production requirements.

Delulu Tees may require full or partial payment before beginning work on a bulk or custom order.

14. Return and Exchange Policy

At Delulu Tees, we take pride in the quality of our apparel and want customers to be satisfied with their purchase. Please review this return and exchange policy carefully before submitting a request.

Eligibility for Returns

All non-bulk and non-custom print orders may be returned within 14 days of the order delivery date.

Items must be:

  • Unwashed
  • Unworn
  • Undamaged
  • Purchased directly from DeluluTs.com

Final sale items are not eligible for returns, refunds, or exchanges.

We can only accept returns for items purchased directly from DeluluTs.com.

Return Shipping

Customers are responsible for return shipping costs for all non-defective items.

Original shipping fees paid at the time of purchase are non-refundable.

Final sale items, late returns, or items sent back without prior return authorization will be considered forfeited and will be handled at Delulu Tees’ sole discretion.

Exchanges

Exchanges are accepted within 14 days of delivery and must be unwashed, unworn, and undamaged.

If an item is being exchanged due to a manufacturing defect or an error by Delulu Tees, we will cover the cost of return shipping and replacement shipping. Customers must contact us with the order number and clear photos of the defect. Once verified, we will provide a prepaid return label and ship a replacement at no additional cost.

If an exchange is requested for reasons other than a defect or Delulu Tees error, the customer is responsible for return shipping and replacement shipping costs.

Custom Merch Returns

Custom merch orders are made specifically for the customer and may have stricter return limits.

Custom merch returns or refunds may be denied unless the item has a verified manufacturing defect or Delulu Tees error.

For approved custom merch returns or exchanges that are not caused by a defect or Delulu Tees error, the customer may be responsible for:

  • Return shipping
  • Replacement shipping
  • Restocking fees
  • Any non-recoverable production costs

Restocking fees may vary depending on the size, type, and status of the custom order.

How to Request a Return or Exchange

  • Full name

  • Request type:
    • Return for refund
    • Exchange for different size or item
    • Exchange due to defect
  • Clear photos of the defect, if applicable

Delulu Tees reserves the right to modify or update this return and exchange policy at any time. Changes will apply to future orders only.

15. Defective or Incorrect Items

If you receive an item that is defective, damaged, or incorrect due to an error by Delulu Tees, contact us at Orders@DeluluTs.com with your order number and clear photos of the issue.

If we verify that the issue was caused by a manufacturing defect or Delulu Tees error, we may offer a replacement, exchange, refund, or other resolution at our discretion.

We may deny claims that are caused by:

  • Normal wear and tear
  • Customer damage
  • Incorrect size selected by the customer
  • Incorrect color selected by the customer
  • Incorrect shipping information provided by the customer
  • Customer-submitted artwork issues
  • Slight color or placement variations
  • Failure to follow care instructions
  • Unauthorized alterations to the item

16. Lost, Delayed, or Marked Delivered Packages

Delulu Tees is not responsible for carrier delays once an order has been handed to USPS.

If a package is lost in transit, contact us and we will review the issue.

If tracking shows that a package was delivered, but you did not receive it, you should first check with USPS, household members, neighbors, building management, mailrooms, or other possible delivery locations.

Delulu Tees does not guarantee refunds or replacements for packages marked delivered by USPS, but we may review these situations on a case-by-case basis.

17. Pricing, Product, Shipping, and Website Errors

Delulu Tees reserves the right to cancel, correct, or refund any order affected by an obvious pricing error, product error, shipping error, website error, inventory issue, technical issue, or other mistake.

If an order is canceled due to an error, Delulu Tees will refund the amount paid for the canceled order.

18. Promotions, Coupons, and Discounts

Delulu Tees may offer promotional codes, coupons, discounts, or special offers from time to time.

Promotions may be limited by date, product, order value, customer, quantity, or other conditions. Promotions have no cash value and may not be combined unless stated otherwise.

Delulu Tees reserves the right to modify, suspend, cancel, or refuse promotions, coupons, or discounts at any time, including in cases of misuse, fraud, technical error, or unintended discount stacking.

19. Product Reviews and Customer Content

Customers may be able to leave product reviews or submit other content on the website.

By submitting a review, photo, comment, testimonial, or other content, you grant Delulu Tees permission to display, reproduce, publish, and use that content in connection with our website, products, marketing, customer service, and business operations.

You agree not to submit content that is false, misleading, defamatory, hateful, illegal, obscene, infringing, spam, or otherwise inappropriate.

Delulu Tees may remove, edit, reject, or refuse to publish reviews or customer-submitted content at our discretion.

20. Intellectual Property

All Delulu Tees website content, branding, product designs, original artwork, logos, text, graphics, images, photos, layouts, and other materials are owned by Delulu Tees or used with permission.

You may not copy, reproduce, sell, modify, distribute, use, or exploit Delulu Tees content without written permission.

Purchasing a product does not give you ownership rights in Delulu Tees artwork, designs, branding, website content, or intellectual property.

21. Customer-Submitted Artwork

You retain ownership of artwork, logos, photos, designs, prompts, reference images, or other content that you legally own and submit to Delulu Tees.

However, by uploading, submitting, or sending content to Delulu Tees, you grant Delulu Tees a limited license to use, store, review, modify, edit, reproduce, and display that content only as reasonably needed to:

  • Review, quote, prepare, produce, fulfill, support, or resolve issues related to a custom merch order; or
  • Review, create, deliver, support, or resolve issues related to an H.I. Image Generator submission.

For H.I. Image Generator submissions, this limited license includes permission for Delulu Tees to use your prompt and optional reference images as part of creating the requested finished image.

This license does not allow Delulu Tees to sell your uploaded content as our own design or use your submitted content for unrelated marketing without your permission.

H.I. images may incorporate stock photography, commercially licensed assets, or other third-party materials. You do not obtain ownership of any third-party stock photograph, licensed asset, or other third-party material incorporated into an H.I. image.

You agree to defend, indemnify, and hold harmless Delulu Tees from any claims, damages, liabilities, costs, or expenses arising from content you submit, including claims that your submitted content violates another party’s copyright, trademark, privacy rights, publicity rights, or other legal rights.

22. Prohibited Uses

You may not use our website, custom merch designer, H.I. Image Generator, products, or services to:

  • Violate any law or regulation
  • Infringe another person’s or company’s intellectual property rights
  • Upload stolen, unauthorized, or infringing artwork, images, photographs, logos, or other materials
  • Submit prompts or reference images that violate another person’s privacy or publicity rights
  • Upload or request sexually explicit, hateful, violent, illegal, abusive, harassing, threatening, or defamatory content
  • Request deceptive, fraudulent, harmful, or unlawful imagery
  • Harass, threaten, defame, exploit, impersonate, or harm another person
  • Submit false, misleading, or fraudulent information
  • Use stolen payment information
  • Interfere with website security or functionality
  • Attempt to access systems or data without authorization
  • Use our website or services for fraudulent, unlawful, abusive, resale, or unauthorized commercial purposes

Delulu Tees reserves the right to refuse service, reject or delete submissions, cancel orders, remove content, or block access where we believe these Terms have been violated.

23. Website Availability

We do not guarantee that our website, custom apparel designer, H.I. Image Generator, checkout, product pages, submission forms, email delivery, or other services will always be available, uninterrupted, secure, timely, or error-free.

We may update, suspend, modify, limit, or discontinue parts of the website or any service at any time.

24. Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, shipping providers, website tools, plugins, or external websites.

Delulu Tees is not responsible for third-party websites, services, policies, content, errors, delays, or actions.

Your use of third-party services may be subject to their own terms and privacy policies.

25. Disclaimers

Delulu Tees provides its website, products, custom merch services, H.I. Image Generator, and other services on an “as available” and “as is” basis, except as expressly stated in these Terms or required by law.

H.I. images are created for entertainment and personal, non-commercial use only. Because they may be created using collage methods, edited images, stock photography, commercially licensed assets, and other third-party materials, Delulu Tees does not represent that an H.I. image is appropriate for resale, commercial distribution, merchandise production, advertising, branding, licensing, or any other commercial purpose.

Delulu Tees does not guarantee that an H.I. image will precisely match a submitted prompt, reference image, requested style, concept, expectation, or desired result.

To the fullest extent permitted by law, Delulu Tees disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.

Some jurisdictions do not allow certain warranty limitations, so some of these limitations may not apply to you.

26. Limitation of Liability

To the fullest extent permitted by law, Delulu Tees will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost business, loss of data, reputational harm, dissatisfaction with an H.I. image, or inability to use an H.I. image for an intended purpose.

To the fullest extent permitted by law, Delulu Tees’ total liability for any claim related to an order, product, website use, custom merch request, H.I. Image Generator submission, or these Terms will not exceed the amount you paid to Delulu Tees for the transaction giving rise to the claim, if any.

Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.

27. Indemnification

You agree to indemnify, defend, and hold harmless Delulu Tees LLC, its owners, employees, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

  • Your breach of these Terms
  • Your misuse of our website or services
  • Your violation of law
  • Your uploaded or submitted content
  • Your prompt, reference images, or other H.I. Image Generator submission
  • Your infringement of another party’s rights
  • Your custom merch order or design request
  • Your use, resale, distribution, or commercial exploitation of an H.I. image
  • Your false, inaccurate, or unauthorized information

28. Governing Law and Disputes

These Terms of Service and any dispute related to Delulu Tees, our website, products, orders, custom merch services, or these Terms will be governed by the laws of the State of California, without regard to conflict of law principles.

To the extent a dispute must be handled in court, you and Delulu Tees agree that the dispute will be brought in the appropriate state or federal court located in California, unless applicable law requires otherwise.

Nothing in this section limits any consumer rights that cannot be waived under applicable law.

29. Changes to These Terms

Delulu Tees may update these Terms of Service from time to time.

When we make changes, we will update the “Last Updated” date at the top of this page. Changes apply to future use of the website and future orders after the updated Terms are posted.
